As an Agency it has always been vital to ensure that you remain compliant with current legislation. It is also important to avoid any potential tax liabilities that could arise if your contractors fail to pay the correct amount of tax, hence the reason for most agencies insisting on limited company status for their contractors.

The third party liability legislation gives HM Revenue & Customs the ability to transfer debts from certain limited companies (typically those managed by a service provider – known as Managed Service Companies) to the worker, the client but, perhaps most importantly, the Agency.
